Terms of Service

Agreement to Terms

By accessing or using Qodie (“the Service”), you agree to be bound by these Terms of Service. If you do not agree with any part of these terms, you may not use the Service. These terms are governed by the laws of the European Union and applicable national legislation.

Description of the Service

Qodie is a web-based QR code generator that allows users to create customizable QR codes. The Service offers both free and paid tiers:

• Free tier: Generate QR codes with custom foreground colors.
• Pro tier (paid): Access to advanced customization including background colors, module shapes, finder patterns, and logo embedding.

Account Registration

To access certain features, you must create an account. You agree to:

• Provide accurate and complete registration information
• Keep your login credentials secure and confidential
• Notify us immediately of any unauthorized use of your account
• Accept responsibility for all activity under your account

You must be at least 16 years of age to create an account, in accordance with the GDPR age of digital consent.

Payments and Subscriptions

Pro subscriptions are billed through Stripe. By subscribing, you agree to the following:

• Billing: Subscriptions are billed on a recurring basis (monthly or annually) as selected at the time of purchase. All prices include applicable VAT where required by EU law.
• Automatic renewal: Your subscription will automatically renew at the end of each billing period unless cancelled before the renewal date.
• Cancellation: You may cancel your subscription at any time through your account dashboard. Cancellation takes effect at the end of the current billing period. No partial refunds are issued for the remaining period.
• Right of withdrawal (EU): Under EU consumer law (Directive 2011/83/EU), you have the right to withdraw from a digital service purchase within 14 days of subscription, provided you have not yet used the Pro features. By using Pro features before the 14-day period expires, you acknowledge and agree that you waive this right of withdrawal.
• Price changes: We may change subscription prices with at least 30 days advance notice. Continued use of the Service after a price change constitutes acceptance of the new price.

Acceptable Use

You agree not to use the Service to:

• Generate QR codes that link to malware, phishing sites, or illegal content
• Distribute spam or misleading content through generated QR codes
• Infringe upon the intellectual property rights of others (e.g., using logos you do not have the right to use)
• Attempt to reverse engineer, exploit, or overload the Service
• Violate any applicable laws or regulations

We reserve the right to suspend or terminate accounts that violate these terms without prior notice.

Intellectual Property

• Your content: You retain ownership of the URLs, logos, and other content you provide to generate QR codes. By uploading content, you grant us a limited license to process it solely for the purpose of generating your QR code.
• Generated QR codes: QR codes generated through the Service are yours to use freely for personal or commercial purposes.
• Our service: The Qodie brand, design, code, and underlying technology are the intellectual property of Ângelo Cunha. You may not copy, modify, or redistribute any part of the Service.

Availability and Warranties

The Service is provided “as is” and “as available”. While we strive for high availability, we do not guarantee uninterrupted or error-free operation. We may perform maintenance, updates, or modifications that temporarily affect availability.

To the extent permitted by EU consumer protection law, we disclaim all other warranties, express or implied, including but not limited to fitness for a particular purpose. This does not affect your statutory rights as a consumer in the EU.

Limitation of Liability

To the maximum extent permitted by applicable law:

• We shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.
• Our total liability for any claim related to the Service shall not exceed the amount you have paid us in the 12 months preceding the claim.
• Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under applicable EU law.

Termination

You may stop using the Service and delete your account at any time through your account settings. We may also terminate or suspend your access if you breach these terms. Upon termination:

• Your right to use Pro features ceases immediately
• We will delete your personal data in accordance with our Privacy Policy
• Provisions that by their nature should survive termination will remain in effect (e.g., intellectual property, limitation of liability)

Dispute Resolution

We encourage you to contact us first at hello@aesc.dev to resolve any disputes informally. If we cannot reach a resolution:

• EU consumers: You may use the European Commission’s Online Dispute Resolution platform (ODR) or refer the matter to your local consumer protection authority.
• Governing law: These terms are governed by the laws of the European Union. Any disputes that cannot be resolved through the above mechanisms shall be subject to the jurisdiction of the competent courts.

Changes to These Terms

We reserve the right to update these terms. Material changes will be communicated via email to registered users at least 30 days before they take effect. Continued use of the Service after changes become effective constitutes acceptance of the revised terms. If you do not agree with the changes, you may cancel your account before they take effect.
